F-4 Visa (Overseas Koreans) â Eligibility Restriction Criteria
Under the Immigration Control Act of Korea, associated regulations, and Ministry of Justice administrative guidelines, the F-4 visa may be denied or restricted in the following cases:
1. Criminal Records
- If the applicant has been convicted of a criminal offense in Korea, especially one resulting in imprisonment or heavier punishment.
- Particularly, those within 5 years of completing their sentence may be ineligible for F-4.
2. Deportation or Entry Ban
- Individuals who have previously been forcibly deported from Korea.
- Those who are currently under an entry ban order.
3. Submission of False or Fraudulent Documents
- Anyone who has submitted false information or used deceptive means to obtain a visa or stay permit in Korea.
4. Violation of Korean Immigration Laws
- Those with a history of unauthorized employment, overstaying, or engaging in activities outside their permitted visa scope.
- For example, entering on a tourist visa and then working without authorization.
5. Threats to National Security or Public Safety
- Applicants deemed likely to threaten public order, national security, or public health, such as:
- Terrorism-related individuals
- Members of criminal organizations
6. Evasion of Mandatory Military Service
- Former or dual nationals who renounced Korean citizenship to evade the mandatory military service may be denied F-4 status.
- This is particularly sensitive for males of Korean descent.
Screening Process
When applying for the F-4 visa, the Ministry of Justice conducts:
- Identity checks
- Criminal background reviews
- Immigration history assessments
Thus, even if all documents are submitted, the final decision is subject to administrative review and can be denied based on internal criteria.
Notes
- These criteria are based on laws and practical guidelines, but individual immigration officers may apply them differently depending on circumstances.
- If your case falls under any of the categories above, you may still apply but must prepare strong evidence and possibly a legal statement (affidavit) to explain and mitigate concerns.
