1. Legal Basis

  • Immigration Control Act – Article 20 (Permission for Activities Beyond the Scope of Status of Stay) A foreigner who intends to engage in activities outside his/her authorized status of stay must obtain permission from the Minister of Justice.
  • Enforcement Decree – Article 25 The Minister may limit the type, duration, place, or hours of permitted employment.
  • MOJ Refugee Affairs Guidelines (Sept. 2022) Refugee applicants (G-1-5) may be allowed to work after 6 months from the date of application if it is deemed necessary for livelihood.

3. Application Procedure

(1) Where to Apply

  • Immigration Office having jurisdiction over your residence
  • Online application (HiKorea): NOT available for G-1 holders
  • You must visit in person (or through a licensed administrative agent)

(2) Who May Apply

  • The G-1 visa holder or an administrative attorney (행정사) with a power of attorney

(3) Fee

  • 130,000 KRW (Government Revenue Stamp)

(4) Processing Time

  • Normally 2–3 weeks

5. Screening Criteria (Used by Immigration Officers)

  • Ongoing refugee review (not withdrawn or rejected)
  • More than 6 months elapsed since refugee application
  • No prior immigration violations or illegal employment
  • Type of work (prefer simple or manual labor)
  • Employer’s legitimacy and compliance with labor laws
  • Contract meets minimum wage and labor standards

6. Permission Details

  • A separate authorization notice will be issued after approval.
  • The allowed employer, workplace, and job category will be noted on the back of the Alien Registration Card.
  • Validity: Up to 1 year, within your authorized stay period.
  • Any change of workplace requires a new permission request.

7. Key Cautions When Preparing Documents

  1. Wage must meet or exceed the minimum wage in Korea.
  2. Working hours cannot exceed 40 hours/week.
  3. Employers cannot hire undocumented or unauthorized workers.
  4. You must report to immigration when changing jobs or ending the contract.
  5. The application must clearly state your visa type (e.g., G-1-5) and refugee case number.

  • 국믌의 음자늬 대첎 가능성 여부
  • 귌로계앜의 적정성 (최저임ꞈ, 귌로시간 등)

5. 허가 낎용 및 유횚Ʞ간

  • 허가 시 허가서 교부 → “첎류자격 왞 활동허가서” 또는 왞국읞등록슝 뒷멎에 “허가 직종, êž°ê°„, 귌묎처” 명시
  • 허가Ʞ간 : 최대 1년 (첎류Ʞ간 범위 낮)
  • 변겜사항(귌묎처 변겜 등)은 재허가 신청 필요

6. 서류 작성 시 죌의사항

  1. 귌로계앜서의 임ꞈ읎 최저임ꞈ 읎상읎얎알 핹 (믞달 시 불허)
  2. 귌묎시간 죌 40시간 쎈곌 불가, 쎈곌 시 불법췚업 간죌
  3. 고용죌는 불법첎류자 고용ꞈ지 규정(출입국ꎀ늬법 제18ì¡° 제1항) 적용 대상
  4. 귌묎지 변겜·계앜만료 시 슉시 출입국청 신고 의묎
  5. 신청서에는 첎류자격(예: G-1-5), 난믌신청번혞, 심사Ʞꎀ명 명확히 Ʞ재할 것
