1. Relevant Law and Administrative Guidelines
According to Article 98 of the Immigration Control Act (âExemption or Reduction of Penaltiesâ) and the Ministry of Justice Guidelines on Voluntary Departure of Illegal Stayers (effective Dec. 16, 2020):
- Voluntary leavers may be eligible for partial exemption or reduction of fines, and
- The entry-ban period depends on the length of overstay and whether the fine is paid.
2. Fine-Reduction Standards

â¡ Because the client has overstayed more than 10 years, she can generally receive up to 70 % fine reduction, but an entry ban of at least 5 years may still apply.
3. Voluntary-Departure Procedure
- Advance report â File a Voluntary Departure Application at the local immigration office before leaving (fingerprinting, passport, and stay record checked).
- Fine assessment & reduction â The office reviews duration, timing of self-report, and circumstances, then issues a reduced fine.
- Departure-confirmation letter â Issued at the airport on departure; this Certificate of Voluntary Departure is mandatory for future visa applications.
4. Re-entry & F-6 Marriage-Visa Eligibility
(1) Entry-ban waiver
Even an illegal stayer may later obtain a Marriage (F-6) visa if:
- The marriage is genuine (not fraudulent),
- Objective proof exists (marriage certificate, photos, messages, pregnancy or birth certificate, etc.), and
- The Voluntary-Departure Certificate and fine-payment receipt are submitted.

(2) Applying in Mongolia
- With the Voluntary-Departure Certificate, the applicant is exempt from the ordinary re-entry waiting period (normally 1â10 years). â She may apply immediately for an F-6 visa at the Korean Embassy in Mongolia.
- However, if the embassy suspects a sham marriage, the visa may still be refused.

- Standard entry ban = 5 years, but it may be lifted for clear humanitarian reasons such as pregnancy or genuine marriage.
- Therefore, self-report â departure â F-6 visa application abroad is the most realistic path.
